1. TERMS OF SERVICE
1.1 The current terms of service (hereinafter referred as "Terms of Use") between Logicfen, S.A.P.I. de C.V., (hereinafter referred as "LOGICFEN"), and you (the "USER"), it is a mutual agreement for the good use of our services, such as accessing our website, the use of the products offered by LOGICFEN (for the purposes of this contract "MYTAKIN") and the use of the system as shown in these Terms of Use. The persistent use of the site and its services (https://www.mytakin.com) are a tacit agreement of acceptance of the Terms of use shown here, if you do not agree, you must suspend the use of MYTAKIN and all LOGICFEN services, or else you should obey all the statements of these Terms of Use.
1.2 LOGICFEN is a company, duly constituted by the Mexican law, and MYTAKIN is a trademark, that allows exchanges, transactions, deposits and withdrawals of cryptocurrencies among the registered USERS in the system, who in turn accept the Terms of Use of this contract.
1.3 LOGICFEN has the right to allow the free and correct use of the service to the USERS that follow the guidelines expressed in Terms of Use. In case of violating this point, such as the use to make money laundering, finance terrorism, counterfeiting, fraud, or any misuse of the service, either of technological aspect, of secuirty, personal or corporative, also the damage by misuse of the service, LOGICFEN has the right to cancel the service of the offenders, regardless of whether they are USERS or visitors, and send them to the authorities so that they apply the corresponding law against them.
1.4 The current Terms of Use are subject to the current law to regulate Financial Technology Institutions and could have changes over time, the date of last update is specified and the USERS will be notified in a timely manner before having a change in the Terms of Use. In case of change, if you continue using our site or services, you tacitly accept the new Terms of Use, otherwise, suspend the use of the site and services.
1.5 The current Terms of Use are made for the laws of Mexico and for good international customs, being able to adapt the Terms of Use to subject the USERS according to the correct use within the local laws of the country where they reside, removing from LOGICFEN all responsibility or failure caused by the misuse of the USERS according to the law. In case of violating local law, the USER is the only responsible and LOGICFEN reserves the right to close his account and send it to the corresponding authorities.
1.6 These Terms apply both to LOGICFEN, and to all its services, including MYTAKIN, leaving the USER under the same responsibility to accept these Terms of Use. Likewise, any violation of these terms by the USER in any of the MYTAKIN services, it is a violation of the USER towards the agreement made with LOGICFEN.
1.7 The current Terms of Use are published in some languages to facilitate reading, but they are only valid for the Spanish language.
1.8 The authorization of the CNBV to carry out this activity is in process so it is not an activity supervised by the Mexican authorities.
2. GENERAL TERMS
2.1 Definitions: For the service we make use of the following definitions (By simplicity, the Terms of Use uses for the third person "he", "his" or "him" regardless of gender):
2.1.1 Service: It is each of the products offered by LOGICFEN, offering freedom to use correctly within the guidelines of Terms of Use. The use of the exchange service, transactions, withdrawals, deposits, informations and other functions, in a correct and legal manner within the laws of the country where the USER is located.
2.1.2 Cryptocurrency: It is a representation of a decentralized digital value, which does not have a legal way or guarantee by the authorities, accepted by USERS who place their trust to make exchanges with other cryptocurrencies, transactions between USERS wallets, electronic payments, among other functions.
2.1.3 Wallet: It is a unique representation of a digital storage place where USERS store their cryptocurrencies.
2.1.4 User: Each person who has an active account in MYTAKIN, having the right to do exchanges, transactions, deposits and withdrawals of cryptocurrencies and use of system functions correctly, with responsibility subject to the guidelines of the Terms of Use.
2.1.5 Guest or visitor: Each person that visits our site or services, but does not has a USER account yet, having limited privileges to consult services and statistics in general, with responsibility subject to the guidelines of Terms of Use. For purposes of the contract, outside the definitions, every visitor is a USER, but not all USERS are visitors.
2.1.6 Market: It is an exchange platform between two cryptocurrencies, as well as the services that integrate it. Services related to a single cryptocurrency are also included here when two or more wallets are involved.
2.1.7 Fee: Numeric amount of which the USERS pay for the use of the service in each transaction, exchange, withdrawal, or use in which the USER makes a movement through a wallet. The charge for the exchange service, transfer, withdrawal, wallet exchange service, among other services where one or more cryptocurrencies are involved, is dynamic and varies according to the transaction demand, outside the MYTAKIN system. A fee is fixed at the moment in which the ticket of the transaction is generated and the user must accept it to carry out the transaction. For Mercadopago the fixed fee is 3.79% + $4.00 MXN, IVA not included.
2.1.8 Transaction: It is any operation made with currencies or cryptocurrencies, in which the USER is involved, it can be an open order, transfer funds to third parties, withdraw funds to USER personal wallets, operations that has fees and any operation that the USER makes through at least one wallet.
2.2 The use of our services is limited in the places where local laws allows the use of cryptocurrencies, its use is prohibited for residents of New York and Washington in the United States, Iran, Afghanistan, Democratic People's Republic of Korea, Syria, Yemen, Bosnia-Herzegovina, Iraq, Ethiopia, Venezuela, Ecuador, Vanuatu, Laos, Uganda and any jurisdiction where the use of digital currency or cryptocurrencies is prohibited. MYTAKIN disclaims all responsibility and this is committed to USERS who violate this prevision. MYTAKIN has the right to cancel the accounts of the infringing USERS.
2.3 All users should have at least 18 years and must act on his own behalf and not of or for a third party. In case the USER does not allow to verify his identity, the service will be canceled for the USER.
2.4 All obligations and duties published in Terms of Use are freely assigned by LOGICFEN without notice of the USERS consent, and it applies if the USER continues to use the site or service. Therefore, the USER should carefully review the updates to the Terms of Use when they are presented.
2.5 The USER should guarantee to LOGICFEN the following:
2.5.1 Tell the truth about the USER personal information when registering or when requested.
2.5.2 Perform valid exchanges and transactions, avoiding inaccurate information, or taking advantage of any malfunction, system error, failure, delay in the transaction, communications failure, code defect or security.
2.5.3 Do not falsify USER accounts or details of its registration.
2.5.4 Do not apply reverse engineering, decompile, disassemble or execute any software that not belongs to the site.
2.5.5 Attempt to harm LOGICFEN or MYTAKIN in any way, through the site or its services.
2.5.6 Do not access through a private network, proxy, network, product, browser or any software that hides the real location or IP address of the USER, if it belongs to a prohibited jurisdiction or if you are a resident of the United States.
2.5.7 Do not use the service for illegal acts, such as money laundering, fraud, forgery, financing of terrorism, financing of drug trafficking, pornography, steals or any illegal activity. If you think to use our services for any illegal activity, or for any of the ones listed above, even if it is indirectly or through a third party, do not use MYTAKIN and LOGICFEN services.
2.5.8 Do not violate the Terms of Use.
2.5.9 In case of involving LOGICFEN in a legal problem due to violation of the Terms of Use by part of the USER, the USER must assume his legal responsibility and pay the expenses generated by the problem, such as lawyers, lawsuits, fines, among others and remove LOGICFEN from any act, damage or injury in peace.
2.6 All cryptocurrencies carry risks of fraud, instability, change of technologies, bifurcations of the chain of blocks, local prohibitions, sudden drop in prices, disuse, among other factors that put the stability of cryptocurrencies at risk, the USER is the only responsible for using them and LOGICFEN is not responsible for these inherent risks of the use of cryptocurrencies. If the USER does not want to assume these risks, avoid the use of MYTAKIN.
2.7 Sometimes the system or the site may have system errors, due to technological, environmental factors, automatic maintenance, among other incidents, which may affect the service of MYTAKIN. Due to MYTAKIN has no control over these incidents, the service could present failures or temporary interruption. USERS who use MYTAKIN are aware of these risks and that MYTAKIN is not responsible for the damages resulting from the incident. You waive any right that you may have against MYTAKIN for this concept. If you do not agree with the above, we invite you to stop using the service and the site.
2.8 All cryptocurrencies or virtual assets are not coins of legal tender or power of attorney in the United Mexican States and are not backed by the government or the Bank of Mexico. In the site or any service of LOGICFEN the USER should use only the cryptocurrencies listed in the active markets of MYTAKIN for its country or region. The USER knows and accepts that cryptocurrencies may cease to exist and consequently the market (s) involved with the cryptocurrency be closed. The USER renounces any action derived to this point and any other concept related to this point against LOGICFEN.
2.9 The USERS that violates local law with respect to operations in LOGICFEN and its product MYTAKIN, as well as committing a crime, such as those listed in point 2.5.7, must renounce all funds in their wallets in favor of what is determined by the authorities, LOGICFEN disclaims all legal responsibility and the USER waives their rights as a USER. If the authority determines it, all the necessary information of the USER will be available to the authority, including transaction history and account information.
3. OPERATING CONDITIONS
3.1 The exchange service, as well the use of all MYTAKIN services are available only to registered USERS, however visitors can access public parts of the site, such as statistics and markets information.
3.2 The USER has the right to publish a new open order (buy and sell) in any active market as long as it meets the requirements of 3.2. If the USER does not agree with the requirements of 3.2, he must avoid to use the services of MYTAKIN as USER. The use of MYTAKIN services is a tacit agreement of acceptance of the Terms of Use, including 3.2.
3.2.1 Have access to all the wallets of the cryptocurrencies involved in the current market before any transaction, created by the same USER within of MYTAKIN and these are active and valid to make transactions.
3.2.2 Not have two wallets of one of the cryptocurrencies involved in the market.
3.2.3 Not share or lend a wallet with other USERS, is for personal and non-transferable use.
3.2.4 Guarantee to have sufficient available funds in his wallets to cover the amount that the USER indicates in the order to publish, including the fees for the use of the service.
3.2.5 Be truthful in the existence of the amounts to publish and not falsify any ticket or order published, neither in its amounts or price and respecting the fees, as well as not modify the automatic calculation of the amounts expressed in the ticket.
3.2.6 Be aware and make an analysis of the amounts in units that the USER wants to buy or sell and the price that requests, LOGICFEN is not responsible for mistakes in transactions due an inconvenient amount for the USER, even if it results in a big loss, even if there were writing errors. It is the responsibility of the USER to be totally sure of the written amounts before publishing the order.
3.2.7 Publish orders only in the markets whose cryptocurrencies are not illegal by the local laws and declare all taxes that local or national law requires. If the law prohibits the use of cryptocurrencies or if you are in a prohibited jurisdiction, avoid to publish any type of order. For Mexico, cryptocurrencies are not coins of legal tender nor endorsed by the authority and the responsibility for their use is exclusive of the USERS.
3.2.8 Understand that the publication of an order may result in the partial or total loss of its value due to the volatility of the markets and the USER is the unique responsible for assuming this risk.
3.2.9 Make the publication of the new order within the MYTAKIN system in a normal and correct way, otherwise, your wallets will be canceled and your USER account suspended.
3.2.10 Understand that if you violate any of the requirements indicated in 3.2, your market wallets will be canceled and your USER account suspended.
3.3 The USER has the right to finish (total or partially) an open order (buy and sell) in any active market as long as it meets the requirements of 3.3. If the USER does not agree with the requirements of 3.3, he must avoid to use the service of MYTAKIN as USER. The use of MYTAKIN services is a tacit agreement of acceptance of the Terms of Use, including 3.3.
3.3.1 Have access to all the wallets of the cryptocurrencies involved in the current market before any transaction, created by the same USER within of MYTAKIN and these are active and valid for transactions.
3.3.2 Not have two wallets of one of the cryptocurrencies involved in the market.
3.3.3 Not share or lend a wallet with other USERS, is for personal and non-transferable use.
3.3.4 Guarantee to have sufficient available funds in his wallets to cover the amount indicated in the open order (to finish an order completely) or the amount indicated on the order ticket (to partially finish an order), in the same way to cover the amount described in any transaction.
3.3.5 Due it is a real-time system, the transaction could be finished or canceled by the issuer of the order before the user accepts it, therefore the status of the order as well as the amount expressed in the order can suddenly change and the transaction could not be carried out when the USER accepts, without affecting the balance of their wallets; or be carried out with less units than those published, respecting the same agreed price, reflecting the actual transaction in the USER's wallets. To avoid these scenarios, the USER must accept the orders immediately, without opportunity or responsibility of LOGICFEN to set aside or reserve any order for the USER. Even when the units change suddenly before the transaction, the price per unit is always respected and the amount of balance in the USERS's wallets reflects the real units transferred with the agreed price, even without being shown on a ticket.
3.3.6 Be truthful in the existence of the published quantities and not falsify any ticket or order published, neither in its amounts or price and respecting the fees, as well as not modify the automatic calculation of the amounts expressed in the ticket. Due it is a real-time system, the quantities of the units of the orders change automatically when an order is partially finished and the USER can see the updated orders, however due to several external factors, among them the speed of the communications in the network, the speed of the nodes and the number of open connections, the amounts could not be updated in time and the USER could not see the updated amounts, so that he can not claim as realized or as valid an order with the amounts that the USER himself visualized and accepted, either completely or partially, if this was already done within the system, because the USER is not affected in the balance of his wallets (if the order was not made) or the USER obtained the remaining units with the agreed price in the USER's wallets.
3.3.7 Accept orders only in markets whose cryptocurrencies are not illegal by local laws and declare all taxes as declared by local or national law. If the law prohibits the use of cryptocurrencies or you are in a prohibited jurisdiction, avoid to finish any type of order. For Mexico, cryptocurrencies are not coins of legal tender nor endorsed by the authority and the responsibility for their use is exclusive of the USERS.
3.3.8 Be aware and make an analysis of the amount in units offered in the open orders and the prices that are requested in these, MYTAKIN is not responsible for mistakes in transactions due an inconvenient amount for the user, even if it results in a great loss, even if it was accidentally. It is the responsibility of the USER to be totally sure of the accepted amounts, especially the price, before finish an order. Finish an order is an irreversible activity.
3.3.9 Understand that closing an order may result in the partial or total loss of its value due to the volatility of the markets and the USER is the unique responsible for taking this risk.
3.3.10 Finish orders within the system created by MYTAKIN in a normal and correct way, otherwise, your wallets will be canceled and your USER account suspended.
3.3.11 Understand that if you violate any of the requirements indicated in 3.3, your market wallets will be canceled and your USER account suspended.
3.4 The USER has the right to cancel an open order of his own (buy and sell), as long as it has not been totally finished, in any active market as long as it meets the requirements of 3.4. If the USER does not agree with the requirements of 3.4, he must avoid to use the services of MYTAKIN as USER. The use of MYTAKIN services is a tacit agreement of acceptance of the Terms of Use, including 3.4.
3.4.1 If the order has not been modified, the reserved amount will be returned to the USER's wallets when he cancels the order.
3.4.2 If the order has been partially closed, the remaining reserved amount of the order will be returned to the USER's wallets when he cancels the order. Due it is a real-time system, it is probable that at the moment of agreeing to cancel the order, the remaining amount is lower than the shown in the order and the refunded amount will be this, the remaining to complete the USER's order (the rest of the units in the order already it was transferred and the USER will not be able to claim them) or the order has been fully covered (you can not claim a cancellation, because the order has been totally finished).
3.4.3 If the order was totally finished before accepting the cancellation of the order, no amount will be returned to the USER, the order was completed.
3.4.4 Any order finished completely can not be canceled, it was totally covered.
3.4.5 Have all the wallets of the cryptocurrencies involved in the current market before any transaction, created by the same USER within of MYTAKIN and these are active and valid for transactions.
3.4.6 Not have two wallets of one of the cryptocurrencies involved in the market.
3.4.7 Not share or lend a wallet with other USERS, is for personal and non-transferable use.
3.4.8 Be truthful in the existence of the orders with the correct price and units published and not falsify any ticket or order published, neither in its amounts or price and respecting the fees, as well as not modify the automatic calculation of the amounts expressed in the ticket.
3.4.9 Guarantee to have sufficient reserved balance in the USER's wallets to cover the amount to be refunded when the USER cancels the open order.
3.4.10 Cancel orders only in markets whose cryptocurrencies are not illegal by local laws and declare all taxes as declared by local or national law. If the law prohibits the use of cryptocurrencies or you are in a prohibited jurisdiction, avoid to finish any type of order. For Mexico, cryptocurrencies are not coins of legal tender nor endorsed by the authority and the responsibility for their use is exclusive of the USERS.
3.4.11 Cancel orders within the system created by MYTAKIN in a normal and correct way, otherwise, your wallets will be canceled and your USER account suspended.
3.4.12 Understand that if you violate any of the requirements indicated in 3.4, your market wallets will be canceled and your USER account suspended.
3.5 The USER has the right to make a transfer to third parties, as well as make withdrawals to their personal wallets and any other transaction, as long as they meet the requirements of 3.5. If the USER does not agree with the requirements of 3.5, he must avoid using MYTAKIN services as a USER. The use of the service is a tacit agreement of the acceptance of the Terms of Use, including 3.5.
3.5.1 The USER has created their wallets within MYTAKIN and these are active and valid for transactions.
3.5.2 Do not have two wallets of the same cryptocurrency.
3.5.3 Not share or lend a wallet with other USERS, is for personal and non-transferable use.
3.5.4 Be truthful in the existence of the amounts at the moment of make any transaction and not falsify any ticket or order published, neither in its amounts or price and respecting the fees, as well as not modify the automatic calculation of the amounts expressed in the ticket.
3.5.5 Have sufficient funds to cover the transaction in the wallets involved, including the part of the fee.
3.5.6 The transactions are irreversible, so that once done, it is impossible for the USER to undo the transaction.
3.5.7 In all the transfers of the USER towards third parties, withdrawals of funds and other services that involve transactions, a ticket is generated the geolocation of the user is obtained.
3.5.8 Perform transactions within the MYTAKIN system in a normal and correct manner, otherwise, your wallets will be canceled and your USER account suspended.
3.5.9 Understand that if you violate any of the requirements indicated in 3.5, your market wallets will be canceled and your USER account suspended.
3.6 The USER must have a six-digit PIN to make any transaction towards any external wallet and must enter it correctly to verify their identity prior to the transaction.
3.7 All transactions require a validation time in the network before displaying the payment reflected in the destination wallet, outside of MYTAKIN system, which appears once the transaction in the network has been definitively confirmed.
3.8 Any attempt to make transactions with unconfirmed balance, as well as trying to modify the internal operation of MYTAKIN, causes the cancellation of the wallets of the offending USER and the closure of his account.
3.9 The network and ecosystem of each cryptocurrency are independent of MYTAKIN and of all LOGICFEN services, therefore LOGICFEN is not responsible for any delay in the transaction, loss of funds, rejection of transactions in the network, bifurcations of the network, denial of service and any negative, abusive or adverse external factor in the network or nodes of the cryptocurrencies. The USER knows the inherent risks that exists in cryptocurrency networks and waives their claim rights for reasons of this concept.
3.10 The USER performs all transactions voluntarily, not by coercion or forced by any person and in the full of their mental abilities.
4. SECURITY
4.1 No algorithm, procedure, commercial secret or internal operation of MYTAKIN shall be revealed to the USER in any way, even when the USER claims against LOGICFEN.
4.2 High security standards are followed to guarantee quality and a secure environment to the USER, on his entry to the system and in the use of all LOGICFEN services, however the USER must take care of his credentials and passwords to avoid steals or faults within his account.
4.3 The login password consists of at least 10 alphanumeric characters, which we recommend for increase the security of your account avoid common or dictionary words, sequences of numbers, names of people, places or any other text that was predictable. The USER must remember the password or write it and keep it a safe place so as not to forget it. Forget the password can cause temporary or permanent blocking of the account, so if the USER does not remember his password, avoid trying to access MYTAKIN and use the password recovery mechanism indicated in the login window.
4.4 LOGICFEN is not responsible for the authentication of the USERS. The USER is the unique responsible in case of being a victim of phishing, steal passwords, fraud, share passwords with a third party, access by a third party or any type of carelessness on the part of the USER. LOGCFEN is not responsible for acts of a third party that affects the Internet service, the IT platform and MYTAKIN site, apis offered by a third party, authentication forms of the USERS or any similar act, releasing to LOGICFEN of all responsibility. The USER waives any right that may correspond in this concept.
4.5 The USER is the unique responsible for any malfunction, steal of information or funds caused by the use of web platforms (including browsers), devices, operating systems, physical or virtual platforms, virtual machines or any third party software, even when the purpose is the use of the MYTAKIN services. The USER understands that his web client must be secure before using MYTAKIN and any LOGICFEN service.
4.6 The USER understands that any valid access for MYTAKIN grants the freedom of use to the services of MYTAKIN, including any operation of payment or transaction, therefore MYTAKIN is not responsible for the steal of information, funds or any type of steal derived from a valid access. The USER is the unique responsible for all movements occurred through a valid access in his account.
4.7 In case the USER fails many times when trying to log in, his MYTAKIN service will be temporarily suspended. In case of negligence or persistence in failing, his service will be definitively canceled.
4.8 The USER must log out once he finishes using the MYTAKIN service, otherwise his account remains active. LOGICFEN is not responsible for operations performed in inactive sessions that have not been closed.
4.9 If the USER detects that his account or credentials have been compromised, he should quickly notify on the contact page or send an email to support@mytakin.com, and he is encouraged to change his password on the login page. If a third party is acting on his own, he must specify it and take the necessary measures to avoid compromising his account. LOGICFEN is not responsible for the damages caused by the negligence of the USER.
4.10 LOGICFEN has the right to suspend and cancel the accounts of the USERS that present suspicious activities, as well as devices that attempt to alter or damage the proper functioning of MYTAKIN in any way.
4.11 LOGICFEN has the right to allow the use of MYTAKIN and its services to the USERS.
4.12 Any USER who attempts to make transactions with non-existent or false data, falsifies or modifies the information of the wallets, falsifies or steals the information about the user accounts and any misuse (accidental or fraudulent) of the LOGICFEN products, produces the cancellation of the USER's wallets and the closure of his service.
5. USER ACCOUNTS
5.1 Visitors over 18 years old can create a USER account, as long as they agree to the Terms of Use.
5.2 Only registered USERS with an active account can make any operation, including exchange and transactions within the system, however, unregistered visitors can consult the markets.
5.3 USERS can only start a session simultaneously by device or web client. In case of requiring to open another session of the same USER in another device or web client, the USER must close his session of the device or previous web client before starting it in the new device or web client.
5.4 Any suspended or inactive USER account requires the full identification of the USER for its reactivation. The USER must write a letter addressed to support@mytakin.com indicating the last known error or last activity made prior to the suspension of the account, his name, his registration email, age, nationality and an official identification that verifies the veracity of USER's data. If the USER with a suspended or inactive account verifies his identity through this procedure and the validation of the information in his wallets is correct, he will have his active account again.
5.5 The USER must login in a browser, device and operating system of trust. LOGICFEN is not responsible for the authentication of the USERS. If a USER repeatedly fail when tries to login, his account will be temporarily blocked and in case of negligence or persistence, his service will be canceled (read Security section for more details).
5.6 The USER must enter his real name as it appears in his birth record when we request it, this will be verified with a valid identity document. If you can not verify your real name when required, your account will be suspended.
5.7 The USER must keep his information updated in the system at all times. The USER can update their address and contact information in MYTAKIN directly once every six months. If the USER needs to update their information before the end of the six months, or requires updating the information regarding their profile, personal identification, real owner information, legal representative information, shareholder information, tax information, beneficiary information or any another type of previously registered information, the USER must send an email to support@mytakin.com, indicating the update to be made, the reasons for the change and the documentation proving the change.
5.8 For the use of the MYTAKIN system, the USER must have an account. The types of available accounts, requirements and necessary documentation are the following:
5.8.1 Experimental Account: For USERS, persons with low risk, with an account limit of 750 UDI per month and a maximum balance of 1,000 UDI. It is required to collect first name and last name, date of birth, gender, country, state, occupation or profession, telephone number and email address.
5.8.2 Personal Account: For USERS, persons with low risk, with an account limit of 3,000 UDI per month for Mexico or 1,700 UDI per month for other countries. It requires collecting the data of 5.8.1 and also the address of the USER, which according to the case includes its street, number, colony, town or municipality, city, state or province and country, and the documentation that proves its data.
5.8.3 Personal Plus Account: For USERS, persons of medium to high risk, with an account limit of 10,000 UDI per month, requires the data of 5.8.1 and 5.8.2 and also nationality, country of birth, CURP or identity document, voting code (Mexico), digital signature, CLABE (if you have one), the manifestation of acting on its own or the identification of the third party in terms of 5.8.3, geolocation and the digital version of the documents that prove its data.
5.8.4 Premium Account: For USERS, persons of high risk or politically exposed persons, without an account limit, who in addition to the documents of 5.8.3, MYTAKIN reserve their right to admit them.
5.8.5 Company Account: For companies. Requires the name of the company, corporate purpose, nationality, RFC or tax identification number, serial number of the electronic signature, address, which as the case may include its street, number, colony, city or municipality, city, state or province and country, telephone number, email address, articles of incorporation, name and last name of the administrator or director, CLABE (if available), digital signature of the legal representative, geolocation, shareholders structure, information of the real owners who have control signed by the legal representative and the digital version of the constitutive act, public registry of commerce (or document of legal stay with apostille), proof of tax identification number and electronic signature, power of attorney the representative or legal representatives, copy of the appointment of the legal representative (according to article 90 of the Law on Credit Institutions or 129 of the Stock exchange, in case of a financial or stock house).
5.8.6 The medium or high risk accounts must go through an interview for authorization.
5.8.7 The high risk accounts of USERS and especially those involving politically exposed persons, LOGICFEN has the right to monitor their transactions and their investigation at institutional level in case of unusual or worrying operations, informing to the authorities if necessary. The high risk USERS grants LOGICFEN this right when creating an account of this risk.
5.9 In the event that an account exceeds the limits established for its type, the USER will be automatically asked for the missing data and documentation for the type of account that fits their funds. If the USER ignores or refuses to deliver the missing documentation and data for their new account type, the MYTAKIN access will be denied to the USER until the missing documentation is sent.
5.10 The USER must add their beneficiaries by sending the name and last name of these, address that may include their street, number, colony, city or town, city, state or province and country, date of birth and the documentation that accredits these. The USER must send it to support@mytakin.com along with the benefit percentage.
5.11 The USER when creating an account does so by their freedom, without coercion by any person or company and in the full of their mental capacities.
6. WALLETS
6.1 USERS have the right to create a wallet free of charge for use within the MYTAKIN services for each cryptocurrency or virtual asset. The wallets must not be shared with third parties or by other USERS and are non-transferable. All USERS needs to generate their wallets for the service before any transaction.
6.2 All USER wallets created in MYTAKIN are internal to the system, any attempt to extract information from the wallet outside the MYTAKIN system, may result in the locking of the USER's wallets.
6.3 USERS are responsible for depositing funds in their wallets, previously created in MYTAKIN, by the the public addresses shown on the site and in the denomination of the cryptocurrency involved. You can also choose to deposit to their registered account on the site.
6.4 The exchange service, transactions and each service offered by MYTAKIN requires the use of valid, unique, non-transferable and active wallets for the cryptocurrencies involved. In case of trying to use any MYTAKIN service with a wallet in any abnormal state either invalid, duplicated, shared, belonging to a third party, falsified, altered, created by a third party or any other state than those authorized in correct use by MYTAKIN, it will be disabled and may not be used in MYTAKIN, as well as causing the suspension of the USER account.
6.5 The available balance in the wallets is shown after verification by the system of the cryptocurrency itself, if the verification does not yet exist, it appears in the pending balance, without the possibility of use until the verification is completed. The verification time depends on several factors such as the speed of the node, the number of available connections to the cryptocurrency network and the speed of the network.
6.6 The available balance in the USER's wallets can be obtained only by any of these four forms:
6.6.1 By an exchange or transfer operation.
6.6.2 By the cancellation of an open order without finish.
6.6.3 By the deposit of balance in the USER's wallets.
6.6.4 By the purchase of balance in the USER's wallets.
6.7 A suspended wallet can be reactivated only if the USER provides full identification and it is verified. The USER must write a letter addressed to support@mytakin.com indicating the last known error or last activity made prior to the suspension of the wallet, his name, his registration email, age, nationality and an official identification that verifies the veracity of USER's data. If the USER with a suspended or inactive wallet verifies his identity through this procedure and the validation of the information in his wallet is correct, his wallet is reactivated with the available balance until before his suspension.
6.8 All wallets are created by the consent and trust of the USERS and are not endorsed by the government or parastatal entities and are not insured by any institution.
6.9 The USER can change the address of his personal wallet (withdrawal) by paying the fees indicated on the site. The wallet will be added to the system after paying the fees and being confirmed in the network.
7. MARKETS
7.1 The USER can only use the services of MYTAKIN in the markets available for his region, whose cryptocurrencies or virtual assets are not prohibited by local laws and he are not in a prohibited jurisdiction.
7.2 Volatility of markets is based on the supply and demand of the USERS transactions. LOGICFEN has no control over prices or market demand, active USERS publish and finish orders freely and this marks changes in prices and demand continuously.
7.3 New markets can open according the existing cryptocurrencies and the acceptance of people, especially the USERS, the markets opens their transactions service only in the places where the law does not prohibit the use of the cryptocurrencies that are part of the market.
7.4 If a market is going to be closed, either by local legislation, by closure of some market cryptocurrency, or by some external factor, the USER will be notified before the closing date of the market, so that him takes forecasts and withdraws his funds in a timely manner; if the USER refuses to withdraw their funds and after the closing time, the market will be closed without any responsibility for LOGICFEN to refunds the amounts not withdrawn.
8. TRANSACTIONS
8.1 The USER is the only authorized to make transactions with his own wallets, where by his free consent he can publish new orders, cancel orders, close order, withdraw balance, pay commissions and any operation with his wallets in MYTAKIN.
8.2 All transactions involving large amounts of currency units (greater than or equal to 7,500 UDIS in a month), will be subject to verification by LOGICFEN, where the USER undertakes to be true to the questions sent by LOGICFEN and in its response to the request for income information or additional receipts such as bills. The information of the operations will be shared with the authorities. If the USER can not verify the origin of the units or amount of money or is negligent in the responses to LOGICFEN, LOGICFEN assumes that it is suspected of illegal financial activity and will be audited, reporting its activities to the authority. LOGICFEN reserves the right to suspend the wallets of the USERS that has illegal financial activity and the cancellation of their accounts, and the USER agrees to resign all funds of their MYTAKIN wallets in favor of the authorities, releasing LOGICFEN of all responsibility in its case.
8.3 The transactions are irreversible, even if they were accidental or fraudulent. The USER is responsible for verifying the amounts of his orders before publishing them and verifying the amounts before finish an order or send any transaction. LOGICFEN is not responsible for the flow of any transaction, either for the benefit or harm of the USERS.
8.4 Make transactions could cause big losses, due to the volatility of virtual assets, there is no guarantee of obtaining any benefit, even when a third party or advertising has indicated. The value of the cryptocurrencies is given by the USERS who trust in them and the prices are based on supply and demand, not manipulated in any way by LOGICFEN.
9. LIMIT OF LIABILITY
9.1 LOGICFEN is not a bank or credit institution, therefore the resources circulating within the platform are deposited and used by the same USERS who trust in the services and platform of LOGICFEN and do not generate additional incomes, only the taxes that the local law sue, being the USER responsible for paying their own taxes if they exist. Neither the services are covered by any insurer.
9.2 LOGICFEN is not responsible for lost or diverted funds by the use of technologies or communications when depositing or transferring cryptocurrencies or money. The USER is the unique responsible for using the technologies that are convenient for him and must be sure that the technologies or software that he uses are safe and free of faults. LOGICFEN is not responsible for the amounts transferred from abroad or to abroad, so the USER must thoroughly verify to which address the funds are sent and in what address the funds will be received before carrying out the deposit and reception operations of cryptocurrencies or virtual assets. The USER waives the right to claim any refund caused by the USER's negligence.
10. INTELLECTUAL AND INDUSTRIAL PROPERTY RIGHTS
10.1 MYTAKIN is a trademark, as well as the MYTAKIN platform, are owned by LOGICFEN and are protected by international industrial property laws. All persons are strictly prohibited from appropriating, copy, display or use of the name, logo or trademark without written permission to do so.
10.2 LOGICFEN reserves all rights over the ideas, codes, developments, methods, technologies, information, trade and industrial secrets, algorithms, protocols, communications, schemes, techniques, formulas, systems, software, documents, designs and parts, both logical and functional, which authorship is LOGICFEN or its USERS, are the property of LOGICFEN and LOGICFEN reserves all rights for the use and exploitation of these, both the patentable, not patentable, the protected by copyright, the protected by industrial property and the creations of LOGICFEN, giving the power to LOGICFEN to take any action necessary in case of any contingency with any person, physical or moral, to claim before the authority the property rights that tacitly belongs to LOGICFEN.
